On this subject: Does anyone know of a database of pistol measurements or something? My next 4 outdoorsy purchases are .300 blk parts (once ATF situation is more settled), new compound bow, new longbow and a 2nd 1911. Timeline is very loose, but I'd like something with a slim frame/milled down grip, single stack 45, 3-3.5ish inch barrel. Finding stats/comparison looking is driving me bonkers.

Odds do not invalidate an individual case. This is one where Texas got it wrong. I have a pretty long list of offences I think civilians should be entitled to shoot criminals on the spot for, but stealing $150 in a fake prostitute scam is not anywhere close to making the list.

Would you agree that stories that are any of the following deserve skepticism: (i) sensational and outrageous, (ii) support one side of a larger political debate, (iii) have neither a citation nor direct quotes from people with first hand information.

This story (at least the one I read) has all the above, and also has the jury "saying" something (without citation) even though juries don't usually say anything, just deliver a verdict.


Here's an account from a progressive lawyer familiar with the case who disagrees with the Texas defense of property law, but has the integrity to explain that the defense lawyers argued lack of intent as well as the Texas defense of property law. And the guy was charged only with murder, which requires intent to kill, so just shooting recklessly like an idiot isn't enough to convict. The last paragraph doesn't mean that the popular version of the story is false. Lots of times things that I think are unlikely are true (wikipedia did beat encarta, the FBI did lie to get a FISA warrant, and amazon did beat barnesandnoble.com), but still.

It's hard to argue that justice was done in this case. I don't love the Texas defense of property law, but on its face it seems pretty narrow for the facts above. For example, deadly force is justified if our idiot "reasonably believes that: (A) the land or property cannot be protected or recovered by any other means;" Note the word reasonably. (Anyone can feel free to argue that Texas juries are idiots (some probably are) and would think the idiot in this case actually had the belief, and it's REASONABLE, but you don't need me to join in.)

It seems like you are making a generalist argument related to other narratives and trying to shoehorn it to this particular case. I don't think it is a good fit.

10,000 foot overview: Was justice done? Heck no, the prosecutor snatched defeat from the jaws of victory, did a bad job at trial and a bad job with pre-trial decisions (i.e failure to bring lesser charges). From a high level, this is a person that should have been punished for breaking a pile of laws walking away scot free b/c the offense did a shit job, not the defense making plays.

100 foot overview: The defense can only fight the case the prosecution brings. If the prosecutor fails to bring non-intent charges/otherwise charge or argue around broad defense property laws (i.e. I'm sure precedent (at least persuasive, if not controlling) could have been found that that can't defend property involved in an illegal act with lethal force), it's not the defense's job to argue as if the prosecutor did.

This is pro-justice, we assume innocent until proven guilty and accept 'guilty' people going free when the prosecution does a crap job b/c that's the price of not having prosecutors do shit jobs and then getting 2nd/3rd bites at the apple.


(although I would argue our broader system is wildly pro-prosecutor).

My only bone to pick is that several articles, all of which seemed to flow from the San Antonio reporting from a single person and had red flags, isn't worth quoting.

My version of your gun purchase: just binged watch PIAA AA and AAA (*) wrestling states and leaving for the NCAA tournament on Wednesday. For be, each is better than the superbowl or world series game 7.

*Still the gold standard of HS wrestling tournaments.
